Refined By Iron is a registered trade name of Amber George Fitness & Lifestyle, LLC, an Arkansas limited liability company (“Refined By Iron,” “RBI,” “Company,” “we,” “us,” or “our”).

These policies govern your access to and use of the Refined By Iron website, including refinedbyiron.com (the “Website”), as well as purchases made through the Website and certain services offered by Refined By Iron.

By accessing or using the Website, purchasing a product, or engaging our services, you acknowledge that you have read and agree to the applicable provisions of these policies.

PRIVACY POLICY

1. Information We Collect

We may collect personal information that you voluntarily provide to us, including your name, email address, telephone number, billing address, shipping address, account information, information submitted through forms, communications you send to us, and information necessary to provide products or services you request.

If you inquire about or enroll in coaching or personal training services, we may also collect information you voluntarily provide that is reasonably necessary to evaluate your request, communicate with you, administer your services, and fulfill our contractual obligations.

When you use the Website, certain information may also be collected automatically, including your Internet Protocol (IP) address, browser type, device information, pages viewed, referring pages, shopping activity, and information collected through cookies or similar technologies.

2. How We Use Personal Information

We may use personal information to:

operate and maintain the Website;
process and fulfill purchases;

administer coaching and personal training services;

3. Shopify and E-Commerce Services

Our online store is hosted by Shopify. When you browse the Website, create an account, place an order, or otherwise interact with the store, information may be processed by Shopify in connection with providing its e-commerce, payment, security, fraud-prevention, analytics, and related services.

Shopify may process information independently or on our behalf depending upon the particular service involved.

Your use of Shopify-powered features may therefore also be subject to Shopify's applicable privacy policies and terms.

Payment information submitted through the Website is processed through Shopify and/or the applicable payment processor. Refined By Iron does not independently store complete payment-card numbers merely because you make a purchase through the Website.

Shopify confirms that merchants and Shopify may have different responsibilities depending upon how particular customer information is processed.

4. Email Marketing

If you subscribe to our email list, request information, or otherwise consent to receive marketing communications, we may use your name, email address, and related information to send newsletters, educational materials, product information, promotions, and other communications from Refined By Iron.

We currently use Kit (formerly ConvertKit) to assist with email-list management and marketing communications. Information necessary to provide those services may be processed by that provider in accordance with its applicable policies.

You may unsubscribe from marketing emails at any time by using the unsubscribe link contained in the email.

Unsubscribing from marketing communications does not prevent us from sending transactional or service-related communications that are necessary to fulfill an order, administer an active service, respond to your request, or otherwise conduct our business.

5. Cookies and Similar Technologies

The Website may use cookies, pixels, local storage, and similar technologies necessary to operate the Website, maintain shopping-cart functionality, remember preferences, provide security features, understand Website usage, and improve the customer experience.

Some of these technologies may be provided by Shopify or other service providers used to operate the Website.

You may be able to manage certain cookie or privacy preferences through your browser or through privacy controls made available on the Website. Disabling certain technologies may affect Website functionality.

Shopify also provides mechanisms for merchants to process qualifying customer access and deletion requests.

TERMS AND CONDITIONS

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Website and your purchase or use of products and services offered through the Website.

By using the Website or purchasing a product or service, you agree to these Terms.

If you do not agree to these Terms, you should not use the Website or purchase products or services through it.

2. Informational and Educational Purposes

Content provided through the Website, blog, social-media accounts, emails, digital products, programs, guides, and other materials published by Refined By Iron is provided for general informational and educational purposes unless you have separately entered into an individualized coaching relationship with us.

General Website content does not create a coach-client relationship.

3. Health, Fitness, and Nutrition Disclaimer

Refined By Iron provides fitness coaching, personal training, nutrition coaching and educational information within the scope of the qualifications and services offered by its coaches.

Refined By Iron does not provide medical diagnosis or treatment, physical therapy, psychotherapy, or services requiring a license that Refined By Iron or the applicable coach does not hold.

Information provided through the Website, digital products, educational materials, social media, email, or general programs is not intended as a substitute for individualized medical advice, diagnosis, or treatment from an appropriately licensed healthcare professional.

You are responsible for determining whether participation in any exercise, nutrition, or wellness activity is appropriate for you and for seeking appropriate professional medical advice when necessary.

4. Exercise and Assumption of Risk

Physical exercise and fitness activities involve inherent risks, including the possibility of physical injury.

By voluntarily participating in exercises, workouts, programs, or activities obtained through the Website, you acknowledge that such activities involve risks and agree that you are responsible for exercising reasonable judgment concerning your participation.

You should discontinue an activity and seek appropriate professional evaluation if you experience symptoms or circumstances that warrant medical attention.

Nothing in these Terms is intended to waive or limit any right or liability that cannot lawfully be waived or limited.

5. Coaching and Personal Training Services

Refined By Iron offers coaching services that may include in-person personal training, small-group training, online coaching, fitness programming, nutrition coaching, accountability, education, or related services.

The particular services provided to an individual client are determined by the service purchased and any applicable coaching agreement, informed-consent document, waiver, questionnaire, or other agreement entered into between the client and Refined By Iron.

Clients may be required to execute additional documents before coaching or training services begin.

These Terms supplement those service-specific agreements. If a provision of a written service-specific agreement directly conflicts with these general Terms regarding that service, the service-specific agreement will control to the extent of the conflict.

6. No Guarantee of Results

Individual results vary.

Refined By Iron does not guarantee any particular weight loss, body composition, strength, athletic, health, appearance, performance, or other result.

Testimonials, photographs, measurements, case studies, and client stories represent individual experiences and are not promises or guarantees that another person will obtain the same or similar results.

Your results may be affected by numerous factors, including adherence, nutrition, training history, lifestyle, medical circumstances, genetics, recovery, sleep, stress, and other individual circumstances.

7. Purchases

By placing an order through the Website, you represent that the information you provide is accurate and that you are authorized to use the payment method submitted with the order.

Prices, product availability, product descriptions, and promotions may change without notice.

We reserve the right to refuse or cancel an order where reasonably necessary because of suspected fraud, pricing or listing errors, product unavailability, payment issues, or other legitimate business reasons.

8. Digital Products

Digital products may include downloadable training programs, guides, educational materials, eBooks, templates, nutrition resources, or other digital content.

Because digital products are delivered electronically and cannot practically be returned once access has been provided, all sales of digital products are final and nonrefundable once the product has been delivered, downloaded, or access has otherwise been provided, except where a refund is required by applicable law.

Purchasing a digital product grants you a limited, personal, nonexclusive, nontransferable license to use that product for your own personal purposes.

Purchasing a digital product does not transfer ownership of the intellectual property contained in the product.

9. Physical Merchandise and Returns

Unused and unworn physical merchandise in its original condition may be eligible for return within 30 days of delivery.

Unless an item arrived damaged, defective, or incorrect, the customer is responsible for return-shipping costs.

Items that have been worn, used, washed, altered, damaged after delivery, or otherwise returned in a condition unsuitable for resale are not eligible for return.

Customized, personalized, or expressly designated final-sale items are not returnable except where required by applicable law.

If an item arrives damaged, defective, or incorrect, contact coachamber@refinedbyiron.com promptly so that we may evaluate and address the issue.

Any refund approved for returned merchandise will be processed to the original payment method, subject to applicable processing and financial-institution timelines.

10. Intellectual Property

Unless otherwise stated, the Website and its original content, including text, photographs, graphics, logos, branding, training materials, programs, guides, downloads, videos, educational materials, and other original works, are owned by or licensed to Amber George Fitness & Lifestyle, LLC d/b/a Refined By Iron and are protected by applicable intellectual-property laws.

You may not reproduce, republish, distribute, sell, sublicense, upload, share, modify, create derivative commercial works from, or otherwise exploit protected RBI materials without prior written permission, except as permitted by law.

Purchasing a program, guide, download, or other product does not grant permission to reproduce or distribute it to other individuals.

11. User Submissions, Reviews, and Testimonials

If you voluntarily submit a review, testimonial, photograph, comment, or other content for publication, any permission to use that material will be governed by the consent or authorization associated with the submission.

Where separate written authorization is required or obtained for the use of client photographs, testimonials, or transformation information, such use will be governed by that authorization.

The Website may contain links to websites, products, applications, or services operated by third parties.

Refined By Iron does not control third-party websites and is not responsible for their content, availability, security, privacy practices, products, services, or terms.

Your interactions with third parties are governed by the applicable third party's terms and policies.

We make reasonable efforts to maintain accurate information on the Website but do not warrant that all Website content will at all times be complete, current, error-free, or uninterrupted.

We may modify, discontinue, correct, or update Website content, products, prices, services, or features without notice, subject to obligations arising from existing contracts or applicable law.

ANY LIMITATION OF LIABILITY APPLICABLE TO COACHING OR PERSONAL TRAINING SERVICES MAY ALSO BE GOVERNED BY THE SEPARATE AGREEMENTS EXECUTED IN CONNECTION WITH THOSE SERVICES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to conflict-of-law principles, except to the extent applicable federal law or other mandatory law controls.

17. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

18. Changes to These Terms

We may revise these Terms from time to time.

Revisions will be posted on this page, and the “Last Updated” date will be updated accordingly.

Changes will not retroactively alter the terms of an existing service agreement except as permitted by that agreement or applicable law.

AFFILIATE AND ADVERTISING DISCLOSURE

Refined By Iron may occasionally recommend products, services, equipment, books, supplements, apparel, or other resources and may use affiliate links in connection with those recommendations.

This means Refined By Iron may receive a commission or other compensation if you make a purchase through certain links, at no additional cost to you.

Refined By Iron currently participates primarily in the Amazon Services LLC Associates Program, an affiliate advertising program through which eligible participants may earn fees by linking to Amazon and affiliated sites.

The existence of an affiliate relationship does not guarantee or imply any particular result from a product or service.

Where required, sponsored content, gifted products, paid partnerships, affiliate relationships, or other material connections will be disclosed in connection with the applicable content.
